Terms of Service

These Terms of Service ("Terms") govern your access to and use of kimi.cam (the "Website") and related services. By using the Website, creating an account, purchasing Kimi AI Tokens ("Tokens"), or selecting "I agree" at checkout, you agree to be bound by these Terms.

You represent that you are at least 18 years old and legally able to enter into this agreement for yourself or the entity you represent.

Your use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

Kimi.cam provides online access to AI-related digital services and usage credits through Tokens. The service is offered as a business-facing and developer-friendly online product.

We may improve, update, or adjust service features, limits, and technical implementation over time to maintain performance, security, and reliability.

Some capabilities may depend on third-party infrastructure and providers. Temporary interruptions, latency, maintenance windows, or upstream outages may affect availability.

You may need an account to access certain services. You must provide accurate, complete, and current registration and billing information.

You are responsible for all activity under your account, for safeguarding your credentials, and for promptly notifying us of any suspected unauthorized access.

If you register on behalf of an organization, you confirm you are authorized to bind that organization to these Terms.

Tokens are prepaid digital usage credits. Token balances, package scope, and usage behavior are defined by the package or product page shown at purchase.

Unless otherwise stated in writing, Tokens expire after [TOKEN EXPIRY PERIOD]. Expired Tokens are not recoverable, reinstatable, or refundable.

Payments are processed through [PAYMENT PROCESSOR NAME]. By purchasing, you authorize charges for selected packages, applicable taxes, and any disclosed fees.

Tokens are delivered digitally after successful payment confirmation. Delivery is typically immediate, but may be delayed by fraud checks, processor review, or technical events.

Because Tokens are digital credits, all sales are generally final once delivered. If you believe you were charged incorrectly or Tokens were not delivered, you must submit a refund request within 7 days of the transaction date.

Refund requests must be sent to the contact email in Section 12 with transaction details and supporting evidence. We aim to acknowledge billing complaints within 2 business days. If a refund is approved, we aim to initiate the refund within 5-10 business days (final posting time depends on your payment provider).

You retain rights to content you submit and are responsible for ensuring you have all required rights, permissions, and legal basis to submit it.

Subject to these Terms, you may use outputs generated through your lawful use of the service. AI-generated output may be non-unique, and similar output may be generated for other users.

All Website software, branding, interface design, and service materials (excluding your submitted content) are owned by or licensed to Kimi.cam and protected by applicable intellectual property laws.

You must use the service lawfully and responsibly. You must not use the Website or Tokens to:

• Generate or distribute illegal, fraudulent, harassing, or hateful content.
• Create malware, phishing campaigns, exploit code, or other cyberattack tools.
• Infringe intellectual property, privacy, publicity, or other third-party rights.
• Bypass, probe, reverse engineer, or interfere with security, rate limits, or platform integrity.
• Use outputs or service data to train, fine-tune, benchmark, or develop competing AI systems without written permission.
• Impersonate people or organizations, including deceptive deepfake or synthetic identity misuse.
• Resell or transfer access rights except where explicitly authorized in writing.

The service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

AI-generated content may be inaccurate, incomplete, or outdated. You are responsible for review and verification before relying on any output.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities.

We may suspend or terminate access immediately if we reasonably suspect fraud, abuse, unlawful activity, material breach of these Terms, or security risk to the service or other users.

You may stop using the service at any time. Termination does not automatically create a right to refund except as expressly described in Section 5 or required by law.

Sections that by their nature should survive termination (including payment, liability, dispute, and intellectual property provisions) remain in effect.

These Terms are governed by the laws of [COUNTRY/REGION], without regard to conflict-of-law principles.

If a dispute arises, both parties will first attempt good-faith informal resolution through written notice to the contact in Section 12 before filing formal proceedings.
